Causing Grievous Bodily Harm with Reckless Disregard

A client was charged with causing grievous bodily harm with reckless disregard which can hold a maximum penalty of 7 years imprisonment. Following a guilty plea, I obtained a sentence of 12 months home detention and 300 hours of community work.

The Charge

He was facing a 12-month disqualification from driving. He could not afford to lose his licence as he worked as a landscaper and needed his car to drive to different work sites.

The Outcome

We successfully made an application under s 94 of the Land Transport Act 1998 – and he was sentenced to community work rather than a loss of licence.
