Bail

CRIMINAL DEFENCE LAWYER – AUCKLAND

When someone is arrested and accused of a crime and brought before the court, the first step is getting bail. The last thing you want while waiting to hear your fate is to be detained in prison or on unnecessarily strict bail conditions. If someone has had many previous criminal convictions and/or is already on bail for something else, then the Police may oppose their bail, which means they ask the court for the person to stay in jail until their case goes to trial or the trial is concluded.

Sometimes it can take a year or more to even get to trial, so it is quite important to secure bail. I have considerable expertise in negotiating bail conditions with prosecutors to convince them not to oppose my client’s bail and enjoy a high success rate in arguing for bail or electronically monitored bail despite police opposition. There have been some cases where I have successfully appealed a District Court decision to refuse bail to the High Court.
