CRIMINAL DEFENCE LAWYER – AUCKLAND

Lodging an appeal

If you are unhappy with a judicial decision, you don’t have to sit and stomach it. Sometimes a judge can make a wrong decision, they are human, after all, and you have the right to appeal it. I can assist you with your appeal against a number of decisions made, including a conviction, bail, pre-trial and sentencing. Available under private instruction.

A qualified lawyer is required to pull together the thorough preparation and defence against a judicial decision in the amount of time you have to lodge the appeal. You can try and go it alone, but they know the system better than you do. Overturning a decision is not an easy feat, but with the right set of circumstances and dedication from your lawyer – you can seek a much better outcome.

Know Your Appeals

Yes, technically, you can. But as previously mentioned, this may not have a positive outcome. A lawyer can do all of this on your behalf and make sure all of your bases are covered.
You have 20 working days from the date of your sentencing or decision to file your appeal to fight it under the Criminal Procedure Act 2011. If you don’t make the appeal in time, you will have to then apply for an extension from Court to be granted more time to lodge the appeal. The court will only allow this extension if it is in the interests of justice to do so.
